These Terms and Conditions govern your use of the website, www.thisme.co (the "Site") and your relationship with People Power Inc Limited (“we”, “us” or “ThisMe”). Please read them carefully as they affect your rights and liabilities under the law.

If you do not agree to these Terms and Conditions, please do not register as a member or use the Site.

1. Introduction

1.1The Site is designed to help you monitor, assess and improve various core skills to help you succeed in the modern workplace through participation in online games. Our service will analyse your performance and provide you with detailed feedback and enable you to track your progress. With your permission, we will also share your results and information with potential recruiters who may contact you in relation to employment opportunities.

1.2These terms will apply to registered members and those who simply view the Site ("you").

1.3By using the Site, you agree to be bound by these Terms and Conditions.

1.4You are responsible for ensuring that all persons who access the Site through your internet connection, and that they comply with them.

1.5Please note that these terms and conditions may be amended from time to time. Notification of any changes will be made via the e-mail address provided by you on registration (if applicable) or by us posting new terms onto the Site. In continuing to use the Site and App you confirm that you accept the then current terms and conditions in full at the time you use them.

2. Registration

2.1You can browse the Site and play the games without registering but if you wish to record your progress or save your feedback you will need to register with us.

2.2When you register as a member we will ask for some of your personal information including your CV and career interests. Any personal information you provide us with will be handled in accordance with our Privacy and Data Protection Policy which can be seen here.

2.3If you register as a member you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting craig.harries@peoplepowerinc.com immediately.

2.4If we have reason to believe that there is likely to be a breach of security or misuse of the Site through your account or the use of your password, we may require you to change your password or we may suspend your account. Until you have changed your password or we have reactivated your account you will not be able to access your membership profile.

2.5You agree that all personal information that you supply to us will be accurate, complete and kept up to date at all times. We may use the information provided to us to contact you.

2.6You must be at least [16] years old to register as a member.

2.7We reserve the right the cancel your membership at any time and for any reason.

3. Profiles

3.1You are not entitled to allow any other person to use or borrow your profile. Any other person who wishes to be a member must register separately and create their own profile.

4. Feedback

4.1You will be able to use the Site to view feedback based on your performance in the games (“Feedback”). Feedback is provided only for the purpose of personal assessment and development and for no other purpose.

4.2Any decisions that you make once you have read or reviewed any Feedback personal decisions for you alone and we will not be deemed to make any personal, employment, business or commercial decisions on your behalf and we will not be liable for the consequences of any such decisions. When making any personal, employment, business or commercial decisions, we will not be liable if you fail to take into account any other factors of which you should be aware.

4.3Feedback should not be regarded as or relied upon as being a comprehensive opinion or assessment concerning your performance. It is provided as one element of your overall employment-related decision making and should not be relied on to the exclusion of other factors.

4.4Feedback is intended to be for your sole use. Any third party that reads, reviews or uses the Report in any way does so entirely at its own risk and we shall not be liable to them in any way whatsoever.

5. Recruiters

5.1If you give us permission to do so, we may share your personal information (including but not limited to you CV, career interests, results from games and Feedback) with selected third party recruiters for the purpose of assessing your suitability, qualifications and skills for employment opportunities and such third party recruiters may contact you in relation to such opportunities.

6. Use and Abuse of the Site

6.1We grant you a limited licence to access and make personal use of the Site, but not to download (other than page caching) or modify it, or any portion of it, except with our express written consent.

6.2Whenever you upload material to the Site you warrant that any such contribution is complete, true and accurate in all respects and you indemnify us for any breach of the warranty.

6.3Any information upload to the Site by you will be your responsibility. You will be personally liable for claim relating to defamation, breach of intellectual property, privacy or any other claim arising from any information that you upload.

6.4You may not upload any offensive, inaccurate, misleading, defamatory, fraudulent or illegal content. If any such content is uploaded by you or if in our opinion any content is uploaded by you which damages our goodwill or the goodwill attaching to the Site we reserve the right at our discretion and without notice to take such action as we deem necessary including removing the content from the Site, blocking access to your profile and terminating your membership.

6.5You agree that you will not:

6.5.1access the Site using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

6.5.2solicit log-in information or access an account belonging to someone else.

6.5.3do anything to disable or impair the proper working of the Site, such as a denial of service attack.

7. Viruses, hacking and other offences

7.1You agree not to upload any files that contain viruses, corrupted files, or malicious code or any other similar software or programs that may damage the operation of another's computer.

7.2You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

7.3By breaching this clause 7, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your membership and right to use our Site will cease immediately.

7.4We will not be liable for any loss or damage caused by viruses, a distributed denial-of-service attack or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

8. Availability of the Site

8.1Although we aim to offer you the best service possible, we make no promise that the services at this Site will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with this Website you should report it to craig.harries@peoplepowerinc.com and we will attempt to correct the fault as soon as we reasonably can.

8.2Your access to this Site may be occasionally restricted or interrupted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can. Access to the Site may be restricted whether or not you have registered with us. Any such restrictions or interruptions shall not constitute a breach by us of these terms.

9. Our Liability

9.1We will operate the Site with reasonable skill and care.

9.2Our liability in relation to this agreement will be limited as follows:

9.2.1we will not be liable for any pure economic loss or for any indirect or consequential loss such as lost data, lost profit, loss of anticipated savings, lost employment opportunities, business interruption or lost reputation arising from the use of the Site;

9.2.2we will not be liable for any loss arising as a consequence of or in connection with the incorrect entry of data by you;

9.2.3we will not be liable for any business, financial, or economic loss nor for any consequential or indirect loss (such as lost reputation, lost profit or lost opportunity) arising as a result of your use of the Site whether such loss is incurred or suffered as a result of our negligence or otherwise.

9.3You agree that having regard to all the circumstances including (without limit) that the use of the Site is free, the purpose of the Site and our efforts to bring this clause to your attention the limitations and exclusions set out in clause 9.2 are reasonable.

9.4Nothing in these terms will exclude or limit our liability for fraud or for death or personal injury arising as a result of our negligence.

10. Cancellation and Termination

10.1If you wish to cancel your membership you can delete your profile through the settings page on the Site.

10.2We reserve the right to terminate your membership immediately without notice if in our opinion you have breached these terms. In the event of termination, we will delete your member profile and may remove Images and Comments which you have placed on the Site.

11. Data Protection Policy

11.1We request that all personal information that you provide is accurate, current and complete.

11.2All notices sent to you will be sent to the email address provided with your registration details (as updated by you). By accepting these terms you give your consent to receive communications from us by email and you agree that all agreements, notices, disclosures and other communications that we provide to you by email satisfy any legal requirement that such communications be in writing.

11.3Any personal information that you provide to us in using the Site or as a member will be handled in accordance with our Privacy and Data Protection Policy which can be seen here.

12. Intellectual Property

12.1The format and content of this Site is protected by United Kingdom and international copyright and we reserve all rights in relation to our copyright whether owned or licensed to us and all rights are reserved to any of our registered and unregistered trademarks (whether owned or licensed to us) which appear on this Site.

12.2This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not systematically extract and/or re-utilise parts of the contents of the Site without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Site without our express written consent.

13. International Use

13.1We make no promise that materials on this Site are appropriate or available for use in locations outside the United Kingdom, and accessing this Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so at your own initiative and are responsible for compliance with local laws.

13.2You shall comply with all foreign and local laws and regulations which apply to your use of our Site or our simple randomisation service in whatever country you are physically located, including without limitation, consumer law, export control laws and regulations.

14. General

14.1These terms and conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

14.2If you breach these terms and conditions and we decide to take no action or neglect to do so, then we will still be entitled to take action and enforce our rights and remedies for any other breach.

14.1We will not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.

14.2We may make changes to the format or content of the Site and services provided by us at any time without notice.
